• Free Messages: New WhatsApp users typically receive up to 10 free messages (Telegram signup allowances may differ) and a limited trial AI image allowance (approximately 4 images) upon accepting Shmooz.ai terms. After the free allowance is exhausted, users may subscribe to a paid plan to continue using the service. Free allowances are not unlimited and may change.
• Subscription: Monthly and yearly subscriptions will automatically renew unless canceled by the user. Cancellation of a subscription can be done at any time by the user under the pricing section in our website via “Manage Subscription”.
• Refunds: Shmooz.ai does not offer refunds for any type of subscriptions or one-time image or video credit top-up purchases, except where required by applicable law.
• Responses: Shmooz.ai is not responsible for fact-checking of any responses provided by the Service or Chatbot. Users are responsible for using and relying on the information provided by the Service and its AI and image generation technologies at their own risk.
• Downtime: Shmooz.ai is not responsible for any downtimes that the Service or its AI and image generation technologies may have. Users understand that there may be times when the service is not available due to technical issues. Such downtime will not warrant a refund.
• Plan Message Limits (Fair Usage): All Shmooz plans — including plans marketed as “Unlimited” — are subject to enforceable numeric message caps. “Unlimited” does not mean infinite or unrestricted messaging. Current approximate message allowances (subject to change at any time) are: Free trial — up to 10 messages; Starter ($3.99/month) — up to 250 messages per billing period; Standard ($7.99/month) — up to 1,000 messages per billing period; Unlimited monthly ($9.99/month) — up to 2,500 messages per billing period; Unlimited yearly ($79.99/year) — up to 20,000 messages per billing period; Lifetime — up to 200,000 messages for the life of the account. Messages sent beyond these limits may result in blocked messaging, additional charges where offered, or suspension of the user's account. Shmooz has the right to change these limits and the fair usage policy at any time. Marketing or pricing language does not override the enforceable caps described in these Terms.
• Image Generation Limits: AI image generation (and related media-generation features that share the same allowance, including certain audio and document generation) is subject to enforceable usage limits based on your plan. Free users receive a limited trial image allowance. Paid subscribers receive a plan-specific image allowance that resets upon subscription renewal or the applicable billing cycle. Shmooz.ai strictly enforces these limits. When your image allowance is exhausted, image generation will be blocked until your allowance resets or you purchase additional image credits.
• Image Allowances by Plan: Included image generation allowances are separate from message limits and may change from time to time. As of the last update to these Terms, approximate included allowances are: Free trial — up to 10 images; Starter ($3.99/month) — up to 25 images per billing period; Standard ($7.99/month) — up to 50 images per billing period; Unlimited monthly ($9.99/month) — up to 75 images per billing period; Unlimited yearly ($79.99/year) — up to 200 images per billing period; Lifetime — up to 200 images. No account may hold more than 200 included plan images at any time before optional top-ups. The allowance in effect for your account is determined by your active plan at the time of use.
• Image Credit Top-Up Packs: Subscribers who exhaust their included image allowance may purchase optional one-time image credit packs: 100 additional images for $10 USD, or 500 additional images for $35 USD. Top-up credits are added to your account balance upon successful payment and may increase your total available image generations up to a maximum of 500 images in aggregate (included plan allowance plus purchased credits). Top-up purchases do not change your message quota or subscription tier.
• Image Credit Top-Up Terms: Image credit top-ups are one-time purchases, not subscriptions. All sales of image credit packs are final. Unused image credits are subject to the maximum balance stated above. Shmooz.ai reserves the right to modify top-up pack pricing, availability, credit amounts, and enforcement limits at any time. Promotional or marketing language (including references to “unlimited” features) does not override the enforceable image or message generation limits described in these Terms.
• Image Limit Enforcement: Shmooz.ai may monitor usage to enforce image and message limits, prevent abuse, and suspend or restrict accounts that attempt to circumvent limits or misuse generation features.
• Inappropriate Use and Unsafe Content: Shmooz.ai may postpone, throttle, temporarily restrict, suspend, or otherwise limit a user’s account and access to the Service if the user sends messages at a very high rate, or if the system detects inappropriate use, misuse, or not-safe-for-work (NSFW) or other prohibited content, with or without prior notice. Shmooz.ai alone determines what constitutes inappropriate use or prohibited content.
• Video Generation Credits: Image-to-video and text-to-video generation are sold separately from subscriptions as prepaid credits measured in seconds (for example, approximately 60, 300, or 600 seconds per pack at then-current prices). Video credits are not included in subscription message or image allowances. Each video uses 2, 5, or 10 seconds from your balance depending on the length you select. Unused seconds remain on your account until used. Video credit purchases are one-time purchases, generally non-refundable except where required by law, and may change in price or availability at any time.
• No Unlimited Guarantee: Notwithstanding any plan name, badge, advertisement, or pricing-page wording, Shmooz does not guarantee unlimited messages, unlimited images, unlimited video, unlimited audio, or unlimited document generation. All usage remains subject to the numeric caps and enforcement rules in these Terms.
• Warranties & Responsibility: Shmooz.ai makes no warranties or representations about the services or products provided. The user assumes all responsibility and risk for the use of Shmooz.ai.
• Intellectual Property: Shmooz.ai owns all rights, including intellectual property rights, in the website and its content. Copying or reproducing any part of the website without written consent from Shmooz.ai is prohibited.
• Account Suspension/Cancellation: Shmooz.ai reserves the right to suspend, postpone, restrict, or cancel a user's account at any time, for any reason, including inappropriate use or detection of not-safe-for-work (NSFW) or other prohibited content as described in these Terms.
• Indemnification: The user agrees to indemnify and hold Shmooz.ai, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of user's use of Shmooz.ai, the violation of these Terms of Service, or infringement of any intellectual property or other right of any person or entity.
• Limitation of Liability: Shmooz.ai shall not be liable for any damages whatsoever, including but not limited to any direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use Shmooz.ai or any part thereof, including without limitation damages arising from exhausted plan allowances, blocked features after limit enforcement, or service downtime.
• Preference of Law and Dispute Resolution: These terms of service shall be governed by and construed in accordance with the laws of United States without giving effect to any principles of conflicts of law.
